The majority of the samples have clearence, although most of the permission was gained after release, unbeknown to the original artist but they have said 'yes' now so they can't sue. The samples that do not have permission are pretty safe as they would fall into the 'unrecognisable by the layman', as in the Beastie Boys ruling. I hope this puts everyone at ease.

I liek Burial even more now. What a brilliant warping of samples into something that sounds only and uniquely like him / her / it / them.

The Beastie Boys used a flute peice, they got permission from the publishers but not the artist. The case rested on the fact the original piece was not distiguisable (by the layman) and that the band had altered it enough to use at their own.
The initial problem arose from the fact that the publisher did not realise that the artist had to OK the sample before they gave permission. But the term 'unrecognisable by the layman' set a presidence for law regarding sampling.
I hope this clears things up.

Good stuff. I guess Kode 9 didn't expect Burial to blow up like he did, so i'm sure now that he'll go out of his way to get sample clearance before any of his releases come out. That might also be the cause of delay for the new 12" actually...

The words spoken in the intro are from David Lynch's INLAND EMPIRE. A great scene I might add.

You can see it listed Here towards the bottom. It's spoken by "street person 1"
The strangest thing is, when I first heard 'Untrue', the mood of the album reminded me of Inland Empire... and then I noticed the quote from the film.

i saw a shitty kids film on tv (just a 30 minute stare) and noticed one bit which was definitely sampled in the burial untrue album
the film is called 'bogus' < 4.6 rating (imdb)

it doesn't make sense to do any sample clearance before someone tells you to do so.
if burial would send out mails for every sample he used, firstly he would have to send a few dozen requests, secondly being a unrecognisable artist he would get 90 % denies.
i once tried to get clearance for using tracks in a non-profit film project and i got 3 of 11 cleared. we still made the movie and noone complains until now.
now when burial is already known clearance is much easier for him. and i can even imagine that most companies/artists really care about this.

it would be quite awesome if for example venetian snares had to clear every sample used. he would never be able to do it. still, as a unrecognisable artist nobody cares about this.
