OK I love this album very much, but every day I am discovering more and more of the source material which made up the album (especially the vocals). Now I won't list them here, but needless to say some of the samples are MASSIVE and I am 99.999% certain that they're unlicensed. If this is the case, Hyperdub would be in serious shit if knowledge of this got to the major labels (and inevitably in the world of the internet, it probably will). This leads me to my main question and one for the musicians/artists on this board (of which I know some are very successful): Would you release music with unlicensed samples in this day and age, especially if they came from major artists and/or film/tv? I've seen so much shit happen to artists like Shut Up And Dance, Jedi Knights and even our good friend Timbaland that I really don't think its worth putting out a record if you know it's gonna sell a lot and be heard by a lot of people (10k+ for example). I think Untrue is a brilliant album, but I just hope it doesn't come back to haunt both the artist and the label in the future. |

I know the source for most of the vocals now and I really like the idea of making a kind of burial sample list, much like people did for dj shadows endtroducing, but theres a few reasons against it: 1) if the samples are unlicensed, it makes it easier for the source artists/labels to target hyperdub 2) it ruins a bit of the mystery and mystique, especially when you realise where some of them came from... I will say that all the samples are used creatively though. |

Interesting to hear where some of the samples came from. I'm pretty sure kode9 and burial would've discussed the samples used on the album and if it could backfire badly after the release. Hmm. I doubt they'de be stupid about it. |

To answer your question BTW, i actually use a sample from the movie "Freaks" as an intro for one of my tracks. It's just this little man in the movie saying "For the most beautiful woman, in all the world". I've only ever uploadet it to myspace, without giving it much thought. I like the sample, because a few people might recognize it, and there are a lot of parallels between that movie, and my track. The track is deleted from myspace now, (by myself), but i might want to use it again, and it might be on an album the next time... (Hopefully fall of 2008 peeps) I will probably try to get it cleared, and if it can't get cleared, it's not THAT big a loss. |

Well lets look at it logistically. The entire Burial albums are built from samples right? Just like Endtroducing by DJ Shadow, it is an album formed in whole by intricately stitching samples and recordings. Now, whereas Shadow chose mainly old, obscure records for his sample bank, it seems that Burial's consists of more modern recordings and a lot of recent films/video games. Both used their libraries VERY well, but it leaves Hyperdub in the position of either licensing all the samples used, or none at all. The fact is, obtaining clearance to use a line of speech from a film is pretty much impossible. You need permission from so many different people and they can charge crazy figures. Financially at least, it just wouldn't happen. Obtaining licenses from the big music studios is also going to cost a fortune, especially for a tiny dubstep label in the UK. The fact there are also no mention of sample licenses in the liner notes.... I may be completely wrong about all the above, but I don't think I am. I can understand the first album as Burial was pretty much unknown at that point and i'm sure sales figures weren't expected to be crazy high. However, by the time Untrue came along, he has already blown up massively with almost 2,000,000 plays on last.fm alone. I just think its incredibly naive of Hyperdub as a label if they'd put something out like this which is sure to sell a lot of units (at least for an indie label) and get such massive exposure online and offline. I really hope it doesn't happen, but I sense a massive shitstorm approaching. |

Again, vsnares probably isn't selling anywhere near the amount of records as Burial. I'm pretty sure both the S/T album and Untrue would/have shifted more than 20,000 records and probably a lot more. You don't get #1 album in the Guardian and the amount of publicity+hype Burial gets without selling lots of records! |

been wondering about this myself and i think you're probably right, first album must've sold a fair bit but i still doubt they'd have the funds to clear every sample. i guess it's just a matter of hoping they don't get picked up on, would be rubbish to see hyperdub get shafted, fingers crossed... most of the vocals are pretty easy to recognize if you know the original though, if legal biz was afoot i would've thought it'd happen sooner. dunno |

(its a cover of ernie halters whisper anyway... this is the closest cover version to the one on untrue, but it could be anything really) |
