Nope, but debts are (well, they have to be paid off out of your inheretence before you get the rest, in many western countries). The line the RIAA are taking is that this person owed them x amount of money, so that out to be paid, before the rest of their estate is past to their heirs.
Whilst I can see (from a legal perspective) why this happens, from a sensible/reasonable/decent perspective (particularly given the "crime" in this case) it's pretty sick. Even from a purely business-minded line of thinking, you think their lawyers would have advised against it due to the bad PR. No on is going to think, "wow, they sued a dead person's kids, they're really serious, I'd best not pirate music". Instead, even people who otherwise agreed with the RIAA are going to think, "These RIAA people are sick fucks, I'll do anything I can to get them shut down."

hmm.. upon closer inspection it seems all they want is to question the deceased persons family about other people involved in the case, as he had indicated to them that he was not alone.. it doesn't necessarily involve sueing(sp?) his family or estate, but.. I think they most likely will anyway...
