if i remix a song, lets say "the day the world went away" from nine inch nails, and i remix it, can i put it on a cd and sell it ?
of course the song name will look like this:
nine inch nails - the world went away(sadist remix)
is this o.k. so ? or don't i even have to write this all above ??
what about using samples from a song in my songs ??

you can do it but if it sells enough copies you can get in serious legal trouble for not clearing it
but no one will notice unless you sell some 10+ thousand copies, so knock yourself out

hey, i mean i don't want to get trouble... and if i SHOULD ask creator if i can make then i WILL do it.
okay okay, i will not sell the 10 thousand copies or what, but i don't think they wouldn't let me do it unless the remix would be really crap...
oh and who do i have to ask ? the musician or the label or who ?? what if the musician died... or the label doesn't exist ?

don't bother.. neither trent nor nothing will ever get back to you, and if you contacted interscope (parent company of trent's nothing records) they'd just say no. if you really believe in the remix, just put it on there. you're in poland anyway so even less people who might disapprove will notice. but yes, ideally you should get the artist's blessing, but in reality you'll never get it because they don't answer emails, letters, or calls.

same thing applies, except if you're just using a sample it's a lot more likely you'll get away with it than if the whole song is just a remix of someone else. in electronic music people just expect to hear samples so it's not a big deal. it's only after you start making a real profit that the original artists try to get a piece of it.

If I made a song and some kid did a remix of it with my artist name in it, like you're doing, and I sued the kid for it, I'd never be able to live with myself.

it's up to you. if it's a big name it might be really obvious and you won't have to do it. if it's someone people don't know it'd be polite and nice of you to credit the original artist.

well just look at the Criminal series on Planet Mu.
they make no secret of the tracks being remixes of pop songs, yet they don't get any flack because of the small numbers its pressed in.

but I got a related question:
you all make music, imagine you make a great track, or a great album... and you put it online...
what if I take it and go to a label saying its mine? and what if they release "my" album?
how can you fight that?

one way is in court, having the source files for the songs. if you cant reproduce the song from the source files then youre assed out and the actual writer will win.

i dont think you could do that, as the record label would probably ask you to send them particular song in program files (not mp3 or audio file) before releasing (at least bigger labels i think)

but it's nearly impossible. with "putting it online" you sure mean services like zebox.com or other. there is always a special point in a faq where's written, that you aren't allowed to sell or duplicate the downloaded songs.

Portland is right. For this reason you should keep the masters in a sealed post dated (IE signed by the post office as sent on a particular date) jiffy bag forever. Even before mailing demo cds out it's worth doing. Everything of mine that has gone to record companies sits in a couple of jiffy bags upstairs as well as some "usable" masters for making duplicates etc.
You can even get a bank to keep your jiffy bagged masters for a small fee if you're serious about it.

NO label should ask you for source files. a master is completely different from the source files that created the song.
the only time source files are needed are for actual remixes. in that case you should be under contract anyway and once that is taken care of there is not much to worry about.

on nacmat's question: yup, it's all source files.
I would be able to reproduce all the individual samples and the "song files" for Cubase - showing the exact build up/structuring of samples and effects used in that program.

sure you could. but you could not reproduce a track completely with only cut up samples from a track. there will be fragments and artifacts in the samples.
a better way to explain it is this, if there is a pad being played in a track that is under the drum track, you could not sample out the pad from the drums. the original creator of the song could isolate that entire pad sequence without the drums. therefore proving that he in fact created the sound and song.
its not a catch all for law suits but holds up well when you need to show that you created the song.

i just number all my releases by hand and keep the 1st 10.
i doubt anyone would steal it. and if they did, who cares, i give them away for free anyway, i'd be flattered if somebody tried to steal it.

You can't do it without permission from the publisher. You can't even give it away free on the Internet.
I thought about this when the Xltronic remix competition was done. I'm curious how Phobia can sell CDRs with those remixes. Have they been cleared or what? Maybe it's just one of those things they let slip through..

Actually the sealed dated jiffybag is a myth it has no baring whatsoever on the copyright but on the plus side you have copyright as soon as you write a track.

No, it doesn't affect copyright- you're right, you have that anyway (in this country, but it's best to put the copyright sign for international reasons...), but it does work in court. If you can prove (and this doesn't even have to be "Beyond Reasonable Doubt"- just "more likely than not" as it'd be civil rather than criminal court) that you had a copy before the label the court would recognise you as the owner of the copyright.
