i really dont see the problem, or it hurting ae in any way
i can imagine why they they don't put it out there, because
it's like snooping into ones private kitchen, but that's as
far as my sympathy goes
:)

Exactly. It's not GPL open source code that was released by
bearded exhibitionist hippie communist scum who expect
everyone to look at their tantric love code. It's code that
was never intended for widespread public release.

Also, it's not some practical code intended to format a
paragraph, connect to a database or teach noobs how to use a
recursive function - it's a piece of functional art used to
generate music that was put on CD and sold many copies.

I keep trying to think of analogies, like stealing their
notebooks or work-in-progress tapes, but more than anything
else it's like stealing pieces of their minds. And there's
something ugly about that.

I was also thinking that this whole let's-imitate-AE thing
is very much like fan fiction. You yes you, young man eager
to bite their style, are no different from an emotionally
ill housewife writing Buffy slash fiction.

Anyone in college ever found another student's work lying
around unattended/a disk in a drive on a communal computer
and had a look for any reason other than IDing it with the
intention of returning it to the owner? If so, this is no
different. Don't put them on a pedastal because they're
famous and/or because this is art as opposed to factual IP.
I'm not saying it's right, but it's not the insidious
"stealing part of their soul" that you're making it out to
be. It's more akin to going through a rival company's bins
looking for corporate intelligence and seeing how they
work/what they're up to.

Uhhhh..... I wasnt stolen. It was just said that to
emphasize its own importance. The ep7 era patch was given
to the Russian band Fizzarum who in fact run a website/forum
which is dedicated to the patch itself. Its out there,
google it, babelfish, whatever.

The confield era patch was in fact given too.

If you actually look at the patch there are hidden gui
elements and locked features included specifically because
there was an intent that the patch would be seen by 3rd
parties. Why would Autechre does this to their own patches
if they didnt think they would get out there?

offline fleetmouse from Horny for Truth on 2006-03-09 10:57 [#01856227]
Points: 18042 Status: Lurker

Was the ep7 patch given to fizzarum with the intent to
distribute?

Was the confield patch given to a prof with the intent to
distribute?

And this bullshit about locked / hidden features... on Mac
each patcher window runs as a separate window. It's a way to
save screen real estate and make things more aesthetically
pleasing after you've set your parameters. It can't be to
hide features from the user - anyone who doesn't know how to
unlock a patch doesn't know anything about max in the first
place.

I'd like to hear what Rob and Sean have to say abourt all
this.

the most amazing part of it is when the patch is used by
autechre, the output is great. when the patch is not used by
autechre the output is pretty bad.

so the lesson learned here is obviously that if you are not
autechre you should not use autechre's input excersizes

i know nobody was saying that the samples were intended to
be 'good' but i'll bet somewhere somebody probably thinks
theyre pants-shitting awesome and for some reason that sucks
to me because the real liccfli is much better

but, regardless, yeah, thats like the pinaccle of nerd-dom
right there. im a geek myself but i dont think i can longer
call myself one after looking at those screenshots. jesus
christ

and its kind of like finding out the spoiler to a movie, you
know? or finding out the magicians trick. you aint guessing
anymore after you know why a certain thing happened. yeah
sure the music is still the same before and after you know
that information, but for some (me) it has a spoiling
effect.

like in one of those samples on that website there's some
parts that sound like a little bit of stuff from cap.iv and
thats one of my favorite fucking songs ever. so now i have
to erase that bit of information out of my head so that i
will not associate it to this patch fiasco when i hear the
song, or ill have to smoke more weed, or something, i dont
know.

jesus fucking christ, look at all the math thats in that
chart/layout control spec, what the fuck. thats just off the
deep end. WHY. i dont want to know that! thats too personal.
i dont want to know that somebody sat down and did all of
that. i cant accept that. it is unacceptable. not really but
you see where im coming from? somebody might think the music
was just a big electronic trick once they saw that screen.
for beat-geeks like us though its pornographic i suppose.

beat-geeks is all we are

i don't think it's a big deal. if you don't understand max
you're going to get fuck all from their patches anyway, and
if you understand it then you'll be making your own too. i'm
sure they'd just say run with it, go and make something
good, but it would have been decent if they consented first
i reckon.

it is.

there was a thread a few years ago on the max/msp forum,
where Dr. Karlheinz Essel said that autechre hacked his
patch. Here is the exact transcript:

"I know that autreche was using my AMAZING MAZE which they
hacked by replacing its original sounds, but still using the
incorporated algorithms. I don't care about this, but I
think it should be credited at least (which does happen only
exceptionally...)"

>> --- kHz
>> --
>>
>> Dr. Karlheinz Essl
>> composer / performer
>> Studio for Advanced Music and Media Technology (Austria)

SEAN BOOTH responds:

"karlheinz
yes i hacked your patch ages ago
no i didnt use it in any of our recordings
i would have credited you
give me a little credit"

then there is a heated argument over the crediting of
instruments on records. Sean responds: "maybe he can explain
how a pencil influences a suicide note."

So I have two points.
1- if you use autechre's patch to make $ from a recording,
give them a credit.
2- the max/msp community shares patches and partial code
*every day* between one another to learn, not to steal.
Sean/Autechre are no exception, they looked not only at
tutorials, but extensively looked at and reworked the
patches of others. It's a part of the learning process.
They also relied on the input of others to solve their
programming problems (but NOT their artistic ones)

Dismiss all notions of intellectual property. It doesn't
enter into it.

That said, these are fun patches! if anyone wants to discuss
them outside of the thread: mail_at_justinmagness.com

To have something like this happen must be a kick in the
pants.

That aside this is a great thing for MAX users. Great
learning tool, and all round fun addition to the virtual
studio.

And you know what? We know Autechre made it, so there isn`t
a complete injustice. They still get credit. This could have
been stolen and sold without anyone knowing who made what or
where it came from.

you may not use any Roland synths, because the sound is
intellecutal property of Roland. etc etc blah blah

Couldnt really be bothered to read all/any of this, but erm
yeah....

any songs I create will now be properly credited to the
Roland corp, TC electronic, AKAI, behringer, Pro tools, et
al
