In most western countries possession and use of the
mushrooms were declared illegal shortly after their
appearance, and therefore their use has been driven
underground and is uncontrolled. An exception to that rule
is Holland and some other countries in the European Union,
where fresh mushrooms can be obtained in smart shops which
cater to the needs of psychonauts and others. Dried
mushrooms however are considered a "preparation" and thus
remain illegal there. Nonetheless there is an active
international trade both in mushrooms and in spores, which
can be easily grown in sterile medium. (See Drug policy of
the Netherlands.) Another exception is the United Kingdom,
where fresh magic mushrooms are legal, and only become
illegal when 'prepared' (i.e. dried, or made into a tea).
Fresh mushrooms are widely available for sale throughout the
UK, but their legal status is currently under review - most
notibly in the new Drugs Bill currently at revue, section
21, which proposes to make any Psilocin containing fungii
(which includes the wild-growing liberty caps) class A
illegal drugs.

"shortly after their appearance"? when did they appear,
1940? 1910? they have existed alongside humans for many
years. they were originally suppressed in the west under
pressure from orthodox christian organizations.

anyway, it's a convoluted and complicated history. in the
us they are schedule 1, meaning they are considered to be
without therapeutic value and are lumped in with cocaine and
heroin. until recently in many states you could sell the
spores, but the federal government has been working to end
this.

07/04/2005: The Drugs Bill received Royal Assent today.

The Drugs Bill received Royal Assent today. The Drugs Act
2005 brings in powers to:

* give the police powers to test for class A drugs on arrest
and require those who test positive to attend a drugs
assessment and follow-up appointment;

* make dealing near a school, or using children as couriers
for drugs or drugs-related money, an aggravating factor in
sentencing;

* introduce a new presumption that those caught with more
drugs than reasonable for personal use intend to supply,
which carries tougher penalties;

* give the police tougher powers to tackle dealers who
swallow their drugs or hide them in body cavities - the
police will be able to order an x-ray or ultrasound, and
magistrates will be able to remand suspected swallowers in
custody for up to eight days;

* tackle the open selling of 'magic mushrooms' by clarifying
the law that fresh mushrooms, as well as prepared ones, are
illegal; and

* establish a new drug intervention order to run alongside
anti-social behaviour orders to address drug misuse by
people committing anti-social acts.

Psilocybin is a Schedule I controlled substance in the US.
Which is the most heavilly regulated.

I'm not sure if that applies to only the refined chemical or
mushrooms containing psilocybin as well, though.

Fuck 'em. Even if they stop selling mushies in bong shops,
there's bound to be a few online distros that'll ship them
(or grow kits) to the uk. More of a hassle though i
suppose.

And yeah, there's tons of liberty caps growing wild if you
know where to look.
