basically, the highest court in the netherlands approved that p2p networks are not responsible for copyright infringment (correct english term? dunno) for what their users are doing.

provider cannot be forced to give users details, at least not in austria and i doubt anywhere in europe.
AND not in america, that's the second recent development
they'll admit defeat on that front and will try with online stores pretty soon

is the decision aimed at the users or the "p2p network" itself?
I'm just thinking that in a true p2p network (such as gnutella) there really isn't anybody to sue _except_ the users.

Whoa, that's a very misleading thread-title. By no means is it legal over here now to share or dl copyrighted material.
All they said was that Kazaa couldn't be held responsible for how people use the network. One newspaper compared it to how you can't blame the person who sold the gun, if it was used to shoot someone.

Stay off Kazaa and on slsk for now - it seems to be under the radar while they go after the big guys.
Now they're doing the same thing in Canada, going after users who share lots of files.

in austria it's illegal to have even the tiniest amount of pot - however, under a certain limit, there is no sueing.
it's legal in that sense - 'literally' illegal, still there is no sueing
(i doubt that my use of the word sueing is proper)

i heard of that, but i think this tactic is on the downhill.
not one person in europe (as far as i know) has been brought to court for p2p yet.
police is rather focusing on child pornography and the likes

technically yes. But when someone says "filesharing" in a place like this, i'm sure we all understand what he or she means, and how it involves violation of copyright laws.

I agree also, but that just shows that we use the incorrect interpretation of the phrase. If I was dutch, then I'd be silly to think that this was an amazing ruling, but the reality of it is different I think. This just means now, that individuals will be tracked down and made an example of.
In my mind, programs such as Kazaa and Soulseek were never really an issue.....its the content of your sharing thats the issue, like many here have said
