does anyone have any experience with this? i'd like to use
some fx'd samples from a recording that's owned by universal
music group, and on the off chance that the track gets
released, i don't want to end up in court. naturally, i
have virtually no production budget since i record
everything on a home-based "studio."

i doubt that planet µ paid for all the samples that were on
"the cosmic forces of µ" so i wonder if it's possible to
get away with some sample snippets if the new recording is
only released independently in the uk.

splodgechops, can you offer any insight into this issue?

if it cant be identified, then you are in the clear.

otherwise, your gonna have to pay. its unlikely anyone will
let you use it free of charge.

Nasty area to get into...

Is it going to be a 500 copy white label pressing? If so,
say "fuck it" and do it anyway. If it's going to be slightly
better distributed, you might want to check the services of
these fine folk:

www.sampleclearance.com
www.musicadmin.com

this later one is used by R&S - the fine Belgian Techno
label where mr. James himself was first signed.

One more tip, at least have a B side that isn't a remix,
preferably do a 4 track ep with it on. That way even if it
becomes a big hit, they won't be able to get all the profits
in royalties...

erm, just checked and it doesn't look like music admin is
about any more. Sampleclearance still works though.

thanks for the input! for the record (no pun intended) the
samples are piano chords, and they are pitch shifted into a
totally different register, and worked into a track of an
utterly different style. but the original track is
co-written by and associated with duke ellington, and in
jazz circles, probably well known. i did contact the
licensing dept at universal and they seemed much more
concerned with the entire master, not a few bits here and
there. certainly, a keen ear with a broad knowledge of jazz
might catch the connection, but it occurs to me also that
legal action against would probably cost a lot more than
what they could hope to recoup.

Just do it. Like J-hok said, if you're under 100,000 units,
which it sounds like you are and will be at least for a
moment, you're small potatoes. Look at Planet Mu's
'Criminal' series, they're jacking whole tracks and getting
away with it. They definitely didnt pay Eminem and MC
Hammer and shit.
