Singer Moana Maniapoto, Moana of the Moa Hunters, has lost
the right to use her own name, at least in Germany.

She's currently on a European tour, but a German company has
asked for all her CDs to be pulled off the shelves.

It says it owns the trademark to her name and has leased it
to someone else.

It's a sound and a name well known to New Zealand audiences
and now Moana Maniapoto is also a hit in Germany, where
she's just been touring.

But the German company called Media XS, owns the copyright
to the name Moana and has licenced it to a German trip-hop
band, also called 'Moana'.

Singer, Moana Maniapoto says: "It's been really, really
frustrating, we're touring playing to thousands of people
and we've got this threat that's been hanging over our head,
the advice that the record company have been given is
legally we don't have a leg to stand on." Yesterday the
record companies reached a temporary truce.

Our Moana's CD is allowed to stay on sale in German stores
until October 31, but after that the album must be
re-called, re-named and re-released under the title 'Moana
and the Tribe'.

Moana Maniapoto says: "It's just cultural appropriation as
far as I'm concerned and I'm fascinated by the fact the
ethics and morals surrounding this legal situation don't
seem to be an issue."

Maori Lawyer Moana Jackson describes this case as a
particularly absurd example of something indigenous people
have endured for years.

Maori lawyer, Moana Jackson says: "I think it's
fundamentally racist and re-affirms the assumption that many
European countries have made for a number of years that
anything indigenous is theirs to claim, redefine and own."

Moana Maniapoto has been told she is not allowed to release
any more CDs in Germany under her name. She told 3 News that
she may use the name 'Heidi' next time she's there.

I am dreading when they will copyright your genetic code
right from under your skin..(I have read news that wheels
are in motion for such arangements..yikes)..so it will be
tough shit if you need treatments involving your own genetic
matter if some stupid crack whore relatives of your went and
sold rights to your genes to get another fix...now that's
what I call royally screwed by the copyright...

The whole notion of copyright is ridiculous to me anyway. I
always thought you have the right to do whatever you can. So
if I can burn discs, I will do it, copyright or no
copyright. If they can't stop me, fuck them. But, as they
very often can't they try to make us feel guilty for
"violating intellectual property". Fuck you, says I. The
material property would not be considered property if I
didn't have the power to take it and protect it. So, the
same extends to "intellectual" realm, as far as I'm
concerned.

the flipside of copyrights..is big green back munchers like
Disney can shamelessly rape and pillage, older stories,
fairy tales, folk tales etc out of basically anywhere in the
world..make tanksers loads of money not even from the movie
but also merchandising, generally cheapening and degrading
the original myth folklore..not only that but their
eurocentric appropriation retools and and mangles the story
that in some cases have existed for hundreds even thousands
of years for cheap family friendly kock about jokes and for
the likes of elton john and phil collins to knock out
bastardized god awful ballads even using some of the
traditional instruments and samples..

its wholesale rape..I tells ya

Now, I do understand artists who hate to see their stuff
plagiarised and dragged into gutter by lesser wannabes, but

But I'm not even talking about it. That's just business,
Metallica and Eminem are shutting down FTP exchange websites
because they want to boost their sales. I'm saying this:
Calvin and Hobbes, the comic strip, you know about it? Bill
waterson, the author, never wanted to let the syndicate make
merchandise based on his characters as he despised the idea.
They never did (even though they own the copyright, not him,
but they turned out to be not so bad in the end). But,
inevitably, someone will say, fuck copyright and make Hobbes
puppets and Calvin puppets etc. Now, as Bill Waterson said
he'd hate to see his characters turned into sellable items,
I guess, he'd sue those guys. Whereas I'd just go out and
kick their asses.

kicking someone's ass instead of using legal stuff... since
laws can come out with such stupid injustices like this
—and it's not only one case; remember this
one?...
besides law's so slow sometimes too, and rich people are
harder to "beat" than poor people...

yeah — sometimes i think our modern society's nothing but
another version, more complicated and hypocritical, of
"jungle law".

(but i know it's just an impression; real jungle law must be
much worse than this.)

That is dumb, there is always a way around these things my
solution would be to use moana maniapoto II, or Moanna
maniapoto etc. No one would really notice, she could still
use the name just on her CD's and stuff just put the 2 at
the end or spell it different.

Copyrights are all messed up. Micheal jackson owns the
rights to quite a few beatles songs, he has sold the rights
for guitar riffs of beatles songs to puff daddy probably
others too. Its not right, puffy is paying micheal millions,
then because he is using what the beatles wrote it sounds
good and familiar so people buy it and he makes million,
there both exploiting the beatles for profit. Mainstream
music right now is a total shame there is no originality.
yeah remixes are cool and all but come on people want to her
new music everything now is trying to sound "familiar". The
thing is mainstream is about money so its crap, people that
do it because they love music and want to create something
new and dont care about pleasing the masses are the ones
making good music.
