i think the main thing that they're concerned about is the whole "donation" thing.
as long as he didn't make any profit from it, i'm guessing there's not much that can be done seriously.....but if they can prove he was making money from it, then that's when it becomes a bit more serious.

wow, i havent had my computer all day, saw oink was down and have been itching to discuss this.
im seriously appalled at this. grant, im not that surprised it happened, but INTERPOL?? thats some pretty serious shit. im almost a bit scared actually, because they at this point know only a widespread attack on users will intimidate us.
that granted, i did indeed have the epiphany of "oh yeah, i felt the same way about napster."
but beyond that, i really think that music (and other media) sharing is a very important thing to move forward as a society. imo, you should not be able to make a living off of selling music. yeah, you should be able to make a few bucks selling physical copies, and obviously live shows warrant payment, but pre-recorded music? art should be a hobby - it's not progressive to a society for people to be paid to self-indulge as music lends itself. work should be productive, art should be a passion.
of course, there's also the argument that all work is some sort of art, we'll see what this brings up.

I agree with you somewhat on filesharing, and would even go as far as to say most pop-stars are grossly over-payed, but I'm not sure about the idea that music/art should necessarily be a hobby, and therefore separate from work. I feel that it's possible that some artists spend their entire day working on art, which might cause working a separate job to be difficult. In these cases, art must also pay the bills. Is it fair to deny great art to force a person to work a "day job"?
My stance on P2P filesharing is that it should only be used as a medium of demonstrating music or software. Of the torrents I've downloaded in the last +/- 12months, I've purchased every game or cd that I actually enjoyed. The rest, I delete from my harddrive to save space/not steal. It's obviously more expensive than just downloading everything for free, but it's cheaper than buying music without having heard it first. I submit that buying/supporting music is its own reward, though you must try to purchase directly from the artist as often as possible. I've forgotten why I thought Napster, gnutella, morpheus were so great back in the day. I'd much rather physically own cds and then rip my own mp3s afterwards. Maybe it's just me.
