On the subject of free speech, I don't think that should extent to being a defense against conspiracy to kill someone (or commit other crime), but this takes the piss. It's very different to jokingly say, Tony Blair is a lying fucker who I'd like to see shot and seriously going about planning to do it with other people.
If you think this is bad, a few years back a UK student had some FBI guys turn up on campus (in the UK) to investigate him after he jokingly mentioned bombing Clinton (then president).

how the hell can they even investigate if the song was stolen, and never even officially released?
so, if i was to record a tape of me saying "i really wish the president was dead", that's alright, but the moment that someone breaks into my house, steals the tape, and puts it on the internet, i'll be investigated?
and what's the government doing with pirated music, anyway?

do you think your free speech means that you can joke that you have a gun with you before you get on a plane?
can you appreciate that whether or not you like the president, he (and all presidents) get many, many death threats, and the only way to know if they are serious threats is to have a policy to invesigate *all* threats?
it was only forty years ago that a united states president was murdered in public.
i feel like i've walked into a room of spoiled children, talking about the unfair limits on what they've taken for granted.

dude
there is SUCH a big difference, between eminem, an artist known for his "shocking" lyrics (or whatever) making a fleeting rap on how he doesnt like the current president (sure, he said dead, but he also wrote a song about killing his wife), and standing up in the terminal of an airport and announcing "ive got a gun"
so dont even give me that crap. you can twist the words, and find "what if" senarios all you like... but this is just plain stupid.

I think they're getting their knickers in a twist of this one. A rapper advocates killing the president. Wow! That's what rappers are meant to do, aren't they? It's what rap was invented for -- 'fight the power' and shit like that. Now, if it were Donny Osmond singing about having the president lined-up in his cross-hairs then it would be worthy of an investigation. Maybe an interogation at Guantanamo Bay.

but what happens when some braindance guy makes a 40 minute noisescape with the phrase kill president looped in... and then he's prosecuted because the world thinks he's a talentless hack... i suppose it doesn't really matter that they investigate him so long as he isn't being seriously inconvenienced by it... after all... the us government did knock off their own man 40 years ago... they don't want other people moving in on their business of which presidents get killed and which don't....

plus, that would be a crap move anyway. there's a way to express your views with more tact and articulation than "kill the president".

zeus, you're mixing up my points. one point is, there are some limits to your "freedom of speech."
number two, the secret service *must* investigate all perceived threats. this doesn't mean that anyone is charged with a crime.
you're one to talk about twisting words. i mainly took issue with the repetitive suggestion that this acknowledgement of an investigation into that publicized lyric represented evidence of a threat to freedom of speech. in my opinion, this thread is the worst of impotent, sour-grapes armchair social criticism.

Yes a lot people don't seem to understand what freedom of speech means or at least intentionally misinterpret it... I think it's quite clear when it's being used to defend a political statement made within the acceptable confines of current democracy. When it's used as a defence against libel, it is quite rightly seen as irrelevant. Your freedom to voice your opinion is one thing... when you state something as if it were fact and it's not, it's a different matter.
You do have to feel for the secret services... on the one hand, people omplain when there is investigation into a comparatively low risk threat like this, yet similarly they're up in arms if there is evidence after a terrorist act that it could of been averted or at least decreased in impact had they acted on uncertain intelligence.

Fun Opinion (NOT FACT):
I believe internet based crime will be the main cause for a standardised legal system (or at least, brought a great deal closer) being implemented in the west within our lifetime.
