sharing your music online

I see a lot of you people are sharing your music online;
and that's great, but aren't you worried that someone might
steal it?

What would happen if someone did, and published it under
their name and got a record contract?

I always wonder that

but I think the answer is something about the masters

They would be quite surprised to find out about my
copyrights. That and i would sick my killer attack anteater
after them.

Enemies lurk everywhere!

seriouly.
what case would you have if someone snagged your tracks, got
a record deal and then released it as their music. Would you
have any rights at all?

offline giginger from Milky Beans (United Kingdom) on 2003-11-25 09:46 [#00964952]

You'd have plenty of rights as long as you could prove that
you originally made it. To replicate a track completely in a
program is nigh on impossible. I make my tracks in Reason.
To copy that track from an MP3 into Reason would be a very
hard task. Easily explainable to a court. I think you're
pretty safe to a certain extent.

true that.

Another example would be if you use Acid Pro you could
easily prove it aswell!

copyright, legally, is automatic from the moment you put it
your creative work in a fixed or tangible form. of course,
registering (paying) for official copyright is much safer
though.

i was on slsk and after finishing d/ling a track from
someone, immediately he started to d/l the same track from
me. i asked him exactly what he was doing and he said "i'm
taking it back"

with mp3.com.au, it will ask you if youre a member of apra,
which protects australian artists rights. not that im a
member :]

so, how can you copyright protect your material legally? I
mean, it's not enough to place copyright ©
2003
on your page is it? Or is that legally
binding?

youre entitled to put 'copyright' yourself, anytime

however you wont have legal backing unless you join a local
organisation.. such as apra

an old trick to do if you are unable to register the
copyright officially is to package up whatever you are
copyrighting and mail it to yourself, preferably registered
mail. Once you get it, never open it and put it away
somewhere safe. If anything were to come up you would have
the postmark as proof you made it before the date it was
postmarked.

you should sign up to apra rockenjohny. i get a check every
year for around $80 for royaltys.

not because of mp3.com.au, but apra will pay you when you
play gigs, get air play, or release your work to the public.

that use to be the case but its not legally binding any
more.
I think being a member of something like apra is probably
the easiest, i think its free to join too.
Tho if you have created it and have the original file i
don't think that is disputable, i guess if you have anything
that shows you created the music before the other person did
then it prooves they ripped you off, its a nasty thing butit
does happen, i think i'm going to join apra.

I generally oppose pictures of humans/girlfriends in a state
of decomposing.

I'm weird, I know.

Hey, I think she's hot, but she seriously needs to take a

to make sure she doesn't come apart.

evidence
