AE lawsuit

american eagle VS autechre
- seems as though without any consideration for all the IDM
kids of this world whatsoever, a preppy fratboy clothing
company lifted the infamous AE
"brand" if you will, from dear ol' booth & brown. should
Autechre file a lawsuit and defend their good name from
being tarnished?

No

Maybe if American Eagle changed their name to Autechre then
theyd have a case.

well, true enough, but doesn't it make you sick seeing all
these preppy jocks with a big-ass AE across their asses?!?
do sean & rob even know about this yet?
i reckon they'd be either horribly appaled or just laught it
off. but think about it - the www.ae.com domain is taken by
American Eagle, and yet it was Autechre who used this letter
combination for commercial purposes first. Sue the
sweatshop labour employing bastards, i say!

Maybe Autechre should either

a) Change the abbreviation to Au

or

b) Say fuggit and concentrate on making another album that
sounds like tri repetae.

They wouldn't have a valid case... unless it could be shown
that people may but American Eagle clothing believing it to
be Autechre clothing.

If Autechre had a substantial clothing line that already
used AE as the main logo they might have a chance. If all
they have is one or two t-shirt designs in the skam shop,
they won't have much luck. Also, given that Autechre are not
generally known they would probably fail the "fame" aspect
required for a successful copyright infringemnet case.
Bitch, eh?

but case in point is this - the other day i was in a record
shop browsing through the latest used CD arrivals, and lo
and behold, a CD with AE on the spine was there ... my first
thought was "hmm, what's this? something by Autechre i have
not yet heard of?" only to find out it was an American Eagle
CD compilation featuring god knows what awful top-40 shite
on it.

moreover, Autechre could have a case if the AE abbreviation
is protected by copyright - thus, irrespective of how well
reknown the Autechre "brand" is compared to the American
Eagle one, by virtue of having copyrighted it first, they
would have a case.

The character where they're joined together like this?

Yep... not sure what that's from, but it's a common one
alright.

'ae' as a letter combination is the old way of writing
'aa'.

can also imply more than one --> larva - larvae

haha! good point! i didn't even think of the obvious!
imagine the shock they will endure when they put on 'gantz
graf' (with perhaps the most prominently featured AE
abbreviation) only to find out that it's nothing like John
Mayer or Dave Matthews at all?!? "what the fuck?!? this
ain't no sunday night football soundtrack! i'm never wearing
sweatpants with AE across my ass again!"

smart one homer! but in the same way, Nike is actually a
Greek (or is it Roman? same difference) goddess, so by that
virtue it is an unalienable part of world's cultural
heritage, and therefore the shoe manufacturer ought to have
no claim on it.

"it is an unalienable part of world's cultural heritage, and
therefore the shoe manufacturer ought to have no claim on
it. "

i dont follow your logic
how many nike customers know that?

so companys should not be able to use words that have been
used before?

the Nike "swoosh" is a far more recognisable and
significant, these days, part of the world's culture than an
ancient european godess (and a minor one at that)

Æ is a common letter in Danish, Norwegian, and other
languages.
It's pronounced like the 'a' in "bad"

If they have æ on their ass then surely they're advertising
that they like anal enemas

Anyway. Who cares if some dumb ass dicks want that latest
clothgin fashion. If it gets æ some mroe sales, even by
accident then it's a good thing. Who knows. They may even
like it and check it out.
