blip.@#*+
it happened in France, so the article is in french sorry. it's just that someone bought a copy-protected CD and couldn't play it because of copy-protection in his/her CD player, so the person sued EMI, asking for a refund for the CD - and won.
it's not much, but... *shrugs* better than nothing, eh?
i wish they would at least mention on online stores (like amazon) when a CD is copy-protected or not!! ' _ '
is there a list somewhere of the labels/artists copy-protecting their CDs?

Justice recognizes that a CD "protected" behaves a "hidden vice" THE WORLD | 04.09.03 | 13h14 • PUT HAS DAY THE 04.09.03 | 15h48 New episode in the battle that book the ufc-que to choose against the officers of the disc. For the association of consumers ufc-que to choose, the system of verrouillage of the CD was "punished by justice". For the national Union of the phonographic edition (SNEP), this one has, to the opposite, legitimized the "technical measures and the possibility for the phonographic producers to protect their recordings". This is little to say that differing the interpretations of a returned judgement, Tuesday September 2, by the high court of Nanterre. This one concerned the action formed by a consommatrice and the ufc-que to choose against the house of discs emi-france and the distribution corporation Auchan on the subject of an alain disc illegible Souchon on a car radio. The fault to a technical device limiting the copy possibilities.
The matter constitutes an episode of more in the battle than takes the ufc-que to choose to oblige the industry of the disc to withdraw these protection systems more and more shed. Destined to fight against the piraterie, they can prevent the reading of the music on the computers, the car radios, indeed the parlor readers.
REIMBURSEMENT OF THE DISC
The court recognized that the alain CD Souchon behaves an "abnormality that restricts his usage and constitutes a hidden vice to the direction of the item 1641 of the civil code", in spite of the étiquetage mentioning the technical device. Emi-france was condemned to reimburse to the pitying 9,50 Euros, be the price of the product. The ufc-que to choose some deducts immediately that "this decision concerns by principle all the equipped CD of a system of verrouillage". She invites the confronted consumers to this problem to ask the reimbursement of the CD, his exchange against a non copy "locked" or a reduction of the price.
But the court judged unacceptable the action of the ufc

------------- But the court judged unacceptable the action of the ufc aiming to forbid to emi-france to use a "technical measure of protection". For the industry of the disc, this is there the essential one. Amy Pinel, emi-france spokesperson, estimate as well as "the ufc did not succeed obtaining an impedes to the "copy-controlled", this that they looked for. For us, they lost, since the decision of the court does not put back in causes the legitimacy of the technical measures or the possibility for the producer to protect the rights of its artists". A more shaded reaction than the one of the SNEP, that, in a communiqué, considers than the judgement "confirms" the legitimacy of such measure. Now, to no moment the court did not pronounce itself on this point.
That could be soon the case. The ufc and the house of discs Warner must rediscover themselves to the court about a disc "protected" of Phil Collins. The equipment concerns this time a computer, and the complaint carries as much on the reading impossibility that on the possibility offered by the law to benefit from a private copy. Julian Dourgnon, loaded with mission to the ufc-que to choose, awaits that the court says at last "if a computer is a device -as another- to read a CD". For the officers, the computer uses approach to copy and to propagate free music.

That's great news. Apparently EMI tell the online retailers that they mustn't put a copy control warning on the webpage because (durr) it might hurt their sales.
Here is a list of known copy-controlled CDs. As far as I was aware all of EMI's future releases (even in the UK) are supposed to be CC'd.

sometimes there are warnings... sometimes not.
on fnac.com, there is a warning for the next A Perfect Circle album, but none for Massive Attack - 100th Window for example... so you know when it's not ok, but not when it is =/
