I got hit by a BMW...

you might remember i got chased down by a bmw a few weeks
ago.. you might also remember (if you read watmm) that
someone stole my rear tire just a few days back, and i had
to pay to replace it..

well.. today, as i was heading down to the electronics
store, i got smashed..

some woman in a bmw tried to make a turn without looking.. i
had the green, she was stopped, so i started riding. just as
i got in front of her, she starts to accelerate, and keeps
going.. right into me!

i ended up on her hood, yelling "it's green!!!"..

luckily i managed to move my leg out of the way in time, but
my bike was not so lucky.. it was rendered unrideable.. bent
wheels, pedals, and a damaged drive train..

here's the remains..

she was nice enough to give me a ride home, and she's going
to take the bike to a repair shop to have it fixed for me..
duno if that was the smart decision or not, but i was kinda
stunned and was basically stranded with an immobile bike.
anyway, i've got all her information..

im disappointed you probably didnt press charges against the

You guys are lucky. In bc, byciclists are considered
vehicles, so if they cause the accident they are accountable
for dammage. Fucking monopolous crown insurance company. I
didn't even have a choice in the matter!!!

I personally believe bicycles should have insurance, they
can and do cause damage/accidents where it is their fault. I
don't see that just because a vehicle is 'unpowered' it
shouldn't need it.

Put a push bike with a 16 stone rider doing 40mph into a
person and you could easily break limbs, etc. I've chucked a
push bike down a road at speed and hit a car with it...

Scooters can weigh less and go slower, yet they are required
to have insurance in most places.

The problem is, when the insurance company finds a way to
save money, they generally will. If their are no witnesses,
the company will almost always rule in favor of the vehicle,
so the byciclist is forced to pay for damages (if they don't
have vehicle insurance). Its a pretty evil scheme. Because
the insurance company has so many powerfull laywers, they
usually win their cases.

Our lot take a different approach. They wanted to pass a law
that made all accidents involving cars/cycles to be found in
the bikes faovur, even if they were the one in breach
of the highway code (the idea being it would make car
drivers more careful/look out for cyclsists). Thankfully it
didn't go through: cycling couriers run red lights etc.
enough as it is. They'd be even worse, and some poor
innocent bugger's insurance premiums would go up, if they
brought it in.

Insurance companies are ****ers though. They almost always
try to get motorcyclists to take 50:50 blame/costs for
accidents, where they were doing everything they were
supposed to and some retard in a car just u-turns/pulls out
without looking. People end up taking their own insurance
companies to court to get them to pay out! :-/

Vehicle insurance is something I'd like to see nationalised,
or at least watchdogged more heavily.

I got hit by a w M w
A short story by ms DeMount Everest

White.. the ceiling was all white... my eyes felt like they
had been open for forever, but they were just opened, still
taking in the visual stimulance of the new day that was
barely scratching its way through the gaps between the
curtains.

A thump. I sat up in my bed and looked around.

Another thump. I quickly turned my head so that my
still-fresh eyes were facing the approximate direction
wherefrom the sound originated.

Once more: thump. My senses quickly combined as the
adrenaline pumped into my blood, and I pinpointed the source
of the sound. The corner of my otherwise white and yellow
room was completely black even though all the lights were
on. I tried focusing my eyes on the dark patch, but they
kept falling out of focus. Thump!

Rub the eyes. Quickly. Quickly. So quick that I wouldn't
miss what was in the corner if it fled. Ready.. set...
THUMP!

It's gone. The corner is as bright as ever.

THUMP! Oh, now the rest of the room is going black. Dark.

I try to move, but I can't. Why am I in this darkness
suddenly? it's supposed to be day!

Then I see the light emerging as I open my eyes again. I
feel my head with my fingertips.. ouch.. there's a bump...
it's rather large. It hurts. Could the stories be true? Yes,
I would think so...

I was most definately.. hit by a w M w

Which scooters weigh less than a bike? Don't think so. I
don't see many bikes going 40mph outside the Tour De France.
Bikes are always going to come off worse in bike/car
collisions. Is insurance for cyclists realistic? For all
the *kids* as well? It would put people off cycling and put
more people in cars.

I hear of so many cyclists getting injured or killed
by motorists who just walk away with a fine or a 6
month ban, pleased you came out alright chaosmachine...

i ended up riding my landlord's old junky bike to work. it
weighs about 60 pounds, and the seat is loose.. talked with
the lady who hit me, probably won't get my bike back until
monday..

You can and do get 50cc scooters with a light rider that
weigh less than a push bike with a heavy rider (which was my
original point- not that the bike itself weighed less).
Haven't you seen the road legal midi-motos? I can easily
pick those up one handed. You can get ones that are even
under 35Kg!

Most serious cyclists regularly get to 40mph+ on downhill
stretches on public roads. I've done it and I'm far from a
good cyclist. In the UK Mopeds/scooters have limiters put in
them to restrict top speed to 35mph, lots of them can't even
make that (ie 30mph top speed). 35mph is easy to exceed on a
push bike. A heavy push bike (taking into account the riders
weight), doing 40mph has a great deal more energy than a
light rider on a midi-moto doing 30mph, and consequently is
likely to do more damage to anything they collide with.

Believe me, I'm not someone who blindly defends 'drivers
rights', I'm a motorcyclist and have got a scar on my leg
from when a mong of a car driver veered into my path. I
believe (and know from bitter experience) that most car
drivers observation is poor and cyclists/motorcyclists are
at risk as a result. However, I believe that is a different
issue entirely to the reasons why push bikes should have
insurance.

Imagine you have saved up for months to buy your first car,
a cyclist clips the door with his handlebars whilst
undertaking you at some lights. It scratches your paintwork
and it costs you £300 for a respray. Shouldn't he have to
pay instead of you? Shouldn't he have insurance to ensure he
can pay?

As to the argument regarding it being unrealistic- it would
be hard to implement, but it'd be very cheap- we're talking
£20-30 a year from most people, tops. Just as low powered
commuter vehicles like scooters cost little to insure
compared to cars, push bikes would be even less. I'm also
not proposing they should have to pay road tax (damage done
to roads by bikes is negligible and they ease congestion.

40mph. I'm on the roads everyday for 2 hours and most
people are going very slow.
Even most of the lycra-clad roadies don't go that fast
except when going down hill. You're talking about a small
elite who are doing 40mph.

I think for the amount of damage cyclists do to cars,
implementing an insurance scheme is a bit over the top. In
over 20 years I've never hit a car (mind you, I've never hit
a car driving either...).

If a cyclist causes damage by scratching your paintwork, yes
get them to pay for it.

Oh, and if a cyclist doing 40mph collides with a car, what
are the odds on survival?

Neither do I on the flat, but that's my point exactly-
downhill you can easily get 30mph. Accidents happen at the
bottom of hills as well as on the flat... and I really don't
believe it's only a small elite that make big speeds: I'd
say 80%+ of mates who ride (even though most of them, like
me, are infrequent and not massively serious about it) have
exceeded 35 on a push bike.

Not great depending on where they hit. If you're wearing a
decent lid and clothes that offer half decent abrasion
protection and just clip it rather than plough into the
side/head on, then you've got a reasonable chance. My dad
came off (after being hit by a car) not wearing a lid at
about 25 and only suffered mild concussion. I've come off at
30 and as I was wearing work boots/trousers and a helmet at
the time, my only injury was road rash on my arm where the
tarmac wore through my fleece and reflective jacket. I
didn't even need hospitalisation and went into work. A mate
came off on a dirt track at close to 30 and despite knocking
his head on a rock, his lid saved him from and injuries
other than a bit of gravel rash.

Also, do you really limit your speed based on this risk?
You're quite capable of being killed by a car rear ending
you when you're pootling along at 10mph wearing high-vis. If
you're really worried about safety at all costs,
cycling probably isn't for you.

I think you're forgetting about the people on bikes who just
tootle along going pretty slowly. They make up the
majority. Old ladies, kids, people just going down to the
shops. Commuters doing 15mph.

No, I don't limit my speed based on the risk of
crashing/being hit. Most of the time I'm going as fast as I
can or close to it.
Crashing, I feel I'm in control of. Being hit I do all I
can when the incidents occur to avoid it. My point was just
not agreeing that most people cycle quickly and therefore
need insurance to cover the all the damage being done to
cars.

I agree crashing due to my own mistakes doesn't scare me
particularly (on any vehicle I use), more being hit by other
people. My biggest fear is cars pulling out in front of
me/kids running into my path (I actually bounced a kid off
my car bonnet due to the latter- thankfully witnesses could
confirm I was doing 10mph under the speed limit and the kid
ran out without looking and there was no way I could stop in
time).

As a sprog I scratched a neighbours car cycling along the
pavement in a daydream. My parent's were mortified and
offered to pay for it, but thankfully the neighbour shrugged
it off. I was only doing about 7 mph at the time :-/
That said, I suppose my age/gender/circle of friends has
skewed my perception of 'the typical cyclist' and that most
people I see on bikes round here are under 16 and don't go
very quick.
